Wade & Silverstein Gets Judge to Dismiss Case

(Santa Clara, CA) June 26, 2006 –The Silicon Valley law firm of Wade & Silverstein declared victory yet again on Thursday. The latest victory involved a judge's dismissal of a lawsuit that was filed against several of Wade & Silverstein's business and personal clients by a landlord corporation.

The lawsuit alleged, among other things, that an automobile corporation and its two founding officers (who desire to remain anonymous) had failed to comply with the terms of their commercial lease and consequently owed the landlord corporation over $40,000 in back rental payments. The landlord corporation was also seeking the reimbursement of attorney's fees and costs amounting to over $50,000.

Shortly after being served with the lawsuit, the defendant automobile corporation and its two founding officers retained the law firm of Wade & Silverstein. Wade & Silverstein took the position that the lawsuit was unfounded and that as a result of the landlord's conduct, it had waived its right to receive any alleged back rent. Subsequently, Wade & Silverstein conducted discovery in the case and the case became bitterly contested. Things were so contested that on one occasion Wade & Silverstein had to obtain a court order in order to get the Chief Financial Officer of the landlord corporation (who is an attorney himself) to submit to his deposition. The Plaintiff Corporation vowed to prosecute the action at all costs.

After Wade & Silverstein completed its discovery of the case, it filed a motion for summary judgment with the court, essentially asking the judge to find in their clients' favor and dismiss the case in its entirety. Last Thursday, a hearing was held on Wade & Silverstein's motion and the judge did exactly what Wade & Silverstein requested, ruling in favor of Wade & Silverstein's clients and dismissing the entire lawsuit. The judge's dismissal will also require the Landlord corporation to reimburse Wade & Silverstein's clients for all of their attorney's fees and costs incurred in the action.

When asked how she felt about the dismissal, Wade & Silverstein attorney Mikela Babayan indicated: “We are so happy that the judge sided with our clients in this case. This was a bitterly contested case that ended just right. I am really happy for our clients.”
